Welcome to Lucky or Not! These Terms of Service ("Terms") govern your use of the Lucky or Not mobile application ("App", "Service") operated by InchCosmos ("we", "us", "our").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

The App and its original content, features, and functionality are owned by InchCosmos and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
You may not copy, modify, distribute, sell, or lease any part of our App, nor may you reverse engineer or attempt to extract the source code of the App, unless laws prohibit these restrictions or you have our written permission.
All your app data, including language preferences and settings, is stored locally on your device. We do not collect or store your personal data on our servers.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
InchCosmos, its subsidiaries, affiliates, and licensors do not warrant that:
Lucky or Not is designed purely for entertainment purposes. Fortune results are randomly generated and have no predictive value. Do not make important life decisions based on results from this App.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL INCHCOSMOS, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE APP.
IN NO EVENT SHALL INCHCOSMOS'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID TO INCHCOSMOS IN THE LAST SIX (6) MONTHS, OR, IF GREATER, ONE HUNDRED DOLLARS ($100).
You agree to defend, indemnify, and hold harmless InchCosmos and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of your use and access of the App, or a breach of these Terms.
You can delete all local data at any time by uninstalling the App from your device. Once deleted, your settings and preferences cannot be recovered.
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the App will immediately cease. You may terminate your use of the App at any time by uninstalling it from your device.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the App.
These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which InchCosmos operates, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by arbitration, using the English language, in accordance with applicable arbitration rules. The arbitration shall take place in the jurisdiction where InchCosmos operates.
If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.
These Terms constitute the entire agreement between you and InchCosmos regarding the use of the App, superseding any prior agreements between you and InchCosmos relating to your use of the App.
The failure of InchCosmos to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by InchCosmos.
